If Ricechex went back and to live in one room of her home to claim it as a primary residence for 2 years, would she avoid the recaptured depreciation from a rental AND also be eligible for the primary residence cap gains exemption if she decides to sells it after living there for 2 years?
Also, if she subletted one room, and "lived" in the other, could she still claim it as a primary residence?

Some info on legal immigration: Most legal immigration needs a sponsor. Since you are talking about in-laws, you can't sponsor them. A Citizen can sponsor parents, minor children, brothers & sisters. If your wife is a US Citizen, she can sponsor for her parents. Sponsoring requires executing a legally binding, "Affidavit of Support", wherein, the sponsor agrees to pay for all expenses of immigrant for 5 years. Now, if they are indigent after 5 years, they can probably apply for SSI/Medical-Medicaid etc., But it is definitely not "get off the boat/aircraft, rush to welfare office" scenario that is sometimes portrayed. I do know many illegals use food stamps, that is because they have minor dependent children, most likely born here in US.
You are correct bsrsharma, I meant "we" as in wife and me. And yes, she is a U.S. citizen. and there is waiting period, I forgot exactly the number of years. Thanks for reminding me (err, not something I personally would prefer actually. This has come up soo many times in discussions at families)
As long as they are over 65, SSI/Medical is available to them after the waiting period. My point is still, the system has a lot of holes for abuse. It needs reform.

I am not white. I guess you could say I would be considered a "minority", even though I don't like to play that card and not really the case in california.
Anyway, I'm not against welfare for the truely poor and needy. America is a very generous country, and that's one of it's strength. BUT, i do feel that sometimes america is TOO generous. See here's my problem with welfare.

This is pretty messed up imho, irrespective of race/ethnicity because these folks have never paid taxes, and yet are taxing the system. And these folks won't ever contribute to the system because they are beyond their earning years. And this happens quite often. In fact, quite often some of these ancestors are extremely wealthy overseas, yet still take advantage of our system's generousity because there is no record of their financial situation overseas.
This sort of abuse makes me sick frankly. Because welfare wasn't defined for this kind of abuse, and sometimes I feel people don't appreciate the generousity of this country. Second, we really can't afford such handouts these days. I wish our government would reform welfare laws frankly to reduce such abuses.
It's unfortunate that sometimes the need to reform policies get mixed with other group's agendas such that it is perceived as racism or what have you. The need for reform seems to get lost in all the politics.

Actually, once upon i time, when I went to a hotel, I did bring my own sheets. I am a product of my mother's bringing, in which she is absolutely a hygene nut. To this day, I won't walk out of a bathroom without a paper towel in hand that I use to wrap the door handle when I walk out. Namely, because many people don't wash their hands when they leave the bathroom.No grilling this weekend. Need to play mr dad because is mom's weekend out.

2)From a bachelor: hot tub used for…Think about everything you plan on doing with it….Uh, never mind.
If you do decide to buy the one from craigslist, please don't use the extra wire to hang yourself. Electrical wire tend to break when subject to human weight and we wouldn't want to see perfectly good electric wire go to waste. Oh yeah, and we love you. :),

CoronitaParticipantYeah, how come Rustico and I didn't get invited to the BBQ, I had to take all the sharp objects and rope out his house. After those attacks I cried for two hours then went to Target to buy more kleenex and asked what section they had a "life" in. The real reson I feel left out on Labor Day is that I don't consider myself much of a laborer, I pay a someone to mow my lawn, clean my house, fix my car, so it seemed appropriate to pay someone to go to the BBQ for me.

There's been more than one person that posted about flames and "getting a life". Actually, I don't think anyone that posts here regularly can't really tell anyone else to get a life with a straight face, if you know what I mean. Ironic isn't it 🙂

1) No I don't live on Torryview. I personally think that development is a little weird.
2) 12615 El Camino Real is a Crest unit that went pending few weeks ago i think. Asking is $565k if I remember. That's like $70k below peak. This unit though faces the street (Elijah, I think).
3) San Rafael has an expensive HOA ($270?/month?)
4) I don't like Palacio (Ruette De Mer) Think there is an elevation problem==> mold/mildew, also too close to 56 ramp.

Seriously though, to the original poster. Run some data on say carmel valley attached market that I commented on days ago. The numbers don't lie.
3/3 townhome was around $620-$650k back in 2004-2005. Latest actual sales comps have been in the $560k/580k.
