I think the local authorities have jurisdiction on the beach, probably somewhere about half way to the mean tide line. Smuggling is against the law and the locals can hold the people for immigration. There could be other laws being broken including human trafficking, sometimes they are bringing in loads of drugs, usually the boats are stolen. That gives the locals probable cause in case any of you are concerned about the Constitutional rights of criminals. FYI- the unemployment rate is skyrocketing in Mexico, so don’t expect this to go away any time soon. Del Mar does not have police in the Del Mar section, they have the Sheriff’s Dept. The section of Del Mar that has a San Diego address is under the jurisdiction of the San Diego Police Department.
