ParticipantI understand where you’re coming from with this comment, but I perceive the biggest problem I will have is finding a suitable place that will even let me move in for 5 months. Maybe it would be easier than I think due to all the foreclosures out there, but I wouldn’t let me move in for only 5 months. Besides, my 1 year old daughter really doesn’t need all the stress of 2 moves in a short period of time, one will be bad enough.

This is actually really good advice as well, and in fact I was planning to call Navy Legal at Port Hueneme on Monday to see what’s available to me. I hope my saga proves entertaining to Piggs as it develops. It can be my Swan Song.

The problem with that is I’m moving in July regardless of my deadbeat landlords, as I’m being relocated to Bethesda Maryland. Do you have any idea what a pain in the ass it’s going to be to move, live there for 3 months , then move again? I would also either have to move myself or incur all the moving expenses, as the move isn’t based on orders by the gov’t. I had to move myself in May 07 into my current house after my prior landlords pulled the rug out from under me, and it was almost more than I could stand. I guess my wife and I have too much crap, but there you go.
And for the prior poster that asked if it was a NOD or NOT, it would seem to be a NOD, as there was a request to call Countrywide to try to settle the debt, rather than vacate for a trustee sale. There was no mention about the duration of the default , however.

ParticipantYeah, I figure we have plenty of time, but I’m really having a hard time paying the rent when I know they’re just pocketing it. I understand the terms of my lease, but it’s galling just the same. The security deposit tactic will work for the last 2 months, but that still leaves Feb and March rents that I have to pony up.
That 60 day law is nice to know about, making it extremely unlikely I will be forced to move before the Navy makes me move in July.
As for the “assignment of rents” I know this place was purchased as owner occupied, as I’ve seen the original mortgage terms on a refi offer that was addressed to me. In addition, the landlord must have tried to do a workout with the bank(s), as we have had 2 mortgage company investigators in the past year inquiring if the home was indeed “owner occupied”. I politely informed them that is was not. Looks like my landlords are just more Trump wannabees who lacked the sophistication to know what they were getting into.
