ParticipantMet with a JAG attorney today. Definitely worth the trip up to Ventura to do it. He reiterated much of what was stated in this thread, especially about the 60 day rent-free period which kicks in immediately after the trustee sale. He also said they can put considerable pressure on the lender to try to keep me in the place until I PCS in the summer (that’s permanent change of station for you non-military types). There is a new provision that states if I get foreclosed out from under me the Navy will pay for the move, which I think was mentioned somewhere above, but will still be a pain. Basically I have a negotiating point of contact with the full weight of the Navy behind him, which is a fairly good position to be in.
I called the landlord today to make arrangements to pick up this month’s check, but they didn’t call me back yet. I imagine they need this money pretty badly, unless they have decided to walk away.

ParticipantI finally talked to the landlord today, and they told me they are in fact trying to do a workout with the lender (Countrywide-good luck with that one). I told them I was going to talk to a Navy attorney tomorrow just to see what my rights are in this situation, and if they can draft any protection for me, such as placing my rent in an escrow account or whatever, if that’s even necessary. They told me they are currently in default, but I “won’t have to worry about my situation”. My rent’s not technically due until the 10th, so I still have a few days. The only way I’ll not pay my rent is if the landlord flat out says “we’re walking away, go ahead and squat”, but they’re not saying that yet. It still infuriates me that for the past 3 months at least my rent payments have not been applied to the mortgage. Oh, and I pay water, but the landlord pays garbage, so I COULD just let the trash pile up in the backyard (just kidding, but sounds kind of poetic when I think about it).

This would likely be quite difficult and extremely expensive, considering I would have to do it up here in LA. I’m also trying to save as much as I can, as I WILL be buying in the DC area in April.
As of now my landlords are not returning my calls. I’m going up to Port Hueneme Wednesday to talk to Legal and see what rights I have, and what the logical next step will be.
I know something is up, as by now we certainly would have received a call to arrange rent pick-up. I would be totally cool with squatting here for the next 5 months if they continue to blow me off. And they can even keep the security deposit! I just have to be careful that I don’t do anything that will jeopardize my credit.

This would likely be quite difficult and extremely expensive, considering I would have to do it up here in LA. I’m also trying to save as much as I can, as I WILL be buying in the DC area in April.

ParticipantI understand where you’re coming from with this comment, but I perceive the biggest problem I will have is finding a suitable place that will even let me move in for 5 months. Maybe it would be easier than I think due to all the foreclosures out there, but I wouldn’t let me move in for only 5 months. Besides, my 1 year old daughter really doesn’t need all the stress of 2 moves in a short period of time, one will be bad enough.
