One of the cornerstones of American governance is the people’s right to criticize their elected leaders.
The privilege — written into the U.S. and California constitutions as well as the San Diego City Charter — often means that politicians must listen at public meetings while they are challenged over decisions like new taxes or development projects.
But sharp words from former three-term state legislator and former San Diego City Council candidate Lori Saldaña during recent public meetings apparently proved too much for Council President Sean Elo-Rivera and Councilmember Marni von Wilpert.
Both elected officials cut off Saldaña as she raised questions about their handling of the COVID-19 pandemic and a proposed Midway District housing and retail complex.
Now the city is being sued in San Diego Superior Court for allegedly violating the Ralph M. Brown Act, the state law that guarantees Californians’ right to participate in public meetings and public discourse.
