Totally disagree with you flu. I’ve seen cases where once a person starts poking back at a Karen Boardmember, Karen Boardmember goes into hyper mode and nitpicks even more.
Try revenge at your own risk and be prepared for years of battle.
I recommend staying focused on the specific issue, like house painting.
Question authority and the authorities will question you.

I am not sure how the HOA can reject your request if you go by what’s in the CC&R. My understanding is that what’s in the CC&R is “legally” binding, the rest of the noise from the HOA reps and whatnots are just their effing personal opinions. If the color and scheme you picked came straight out of the CC&R then push back nicely using the CC&R as the basis for your argument.

For example, in RSF, the Art Jury ( same as an ARC ) has language to not have ‘linear’ rows of plantings. Most tracts do not go into this level of detail and if they don’t have a written rule or history, then challenges usually tips in favor of the owner.
It is conceivable that in this case the ARC is trying to prevent same color schemes in adjacent homes.
All said, the lawyer letter is the most effective way of responding to any HOA complaints.

That sounds about right. In my community the CC&R spelled out the colors and schemes and also that no x number, I think it’s 2, houses in the row should have the same colors and scheme.
I have not threatened my HOA with lawyers before but have used the “cease and desist” words in a couple of my responses to their naggings. It’s actually worked wonder.
Basically, if the OP go by the book and comply with what’s in the CC&R then there shouldn’t be any problems…unless that is….

You have picked from an approved published list.
Paint and send a letter stating there is no rule or policy that you have violated and will be painting per your original ARC submission and expect written approval in 10 days. Any further discussion by the ARC will be interpreted as harassment.
Done.

I am back and happy for two reasons:One very important: “Trumpet (sic)” -like my 5 yr old calles him – lost!! and I had the opportunity to teach my kids (5 and 8) about compassion, racism, equality, taxes, life penalty, abortion or prolife depending how you see it, a women vicepresident, etc and my 8 yrs old was asking every other hour for the past 2 days if Georgia or Pennsylvania has turned blue yet. Note this kids are on still on paw patrol and sofia de first so I was very impressed they cared and listened.
I do not support all democrats policies the same way that I don’t support all republicans policies that is why I am independent. But this election, I voted to remove hate, narcissism and lack of compassion from the White House and Biden was the best choice. Additional bonus to have a woman with diverse ethnic background and most importantly with strong qualifications be a VicePresident.I lived in a country where a corrupt narcist president also lost a reelection race and he just didn’t show on to the change of command ceremony. It wouldn’t surprised me that it will happen in this case too.
Second, and the reason I commented on this thread, is to share that I finally – after almost 4.5 months, I finally got approval on the color of my house. I spoke to the lawyer from my work service and he was ready to write a letter but my husband is a non-conflict person so we went to 3 more back and forth – including one when I said ok I will use the stucco color from the last recommended schemes for my house – if I get the trim and accent colors I want – and then they said “oops that color was not allowed we made a mistake”!!!! It was so ridiculous. I did tweak the main stucco color which I think will be better but they agreed to the 3 colors I wanted. My gray and blue! On the not so bright side, they approved just when rainy season start. My painter is available on Thanksgiving week so my crossing fingers it will be a dry week if not we will be the house with the 17 different patches of color painted until it dries again.

[/quote]Totally with you here. I’ve never registered Democrat or Republican – or any other party – in my entire life, but this election was about so much more. So much more.
I think Biden will do exactly what he said he will do and be a compassionate, understanding leader who will reach out to both sides.
And I’m over the moon about a female VP!

Don’t worry about the rain. It doesn’t rain that much and usually most paints dry within 1-2 days, it should be fine.
