we let corporations discharge debt in Chapter 11 and businesses are utterly ruthless, why do we put the dog on people who marry, have kids, etc..
If there is fraud, go after them, but, the system is awash in debt, that has to end.

but, we basically have 2 major areas of civil law : Contracts and Tort.
In Contract 2 people make an agreement over time for value exchange.
Contracts can be very broad, as long as they don’t violate public policy.
(I.E. No contract for slavery, prostitution, child sales, organ sales,,,)however
Tort law is the stuff of harms. It’s a different type of harm where your rights or
person are harmed and settled with monetary damages.Now the general rule is that in all torts, there is a contract action and in all contract actions, there is a tort. Not 100% but you look for them.
so here’s the deal.
if the contract had a material mistrepesentation, that’s fraud, so you can
breach the entire contract, it’s null and void on it’s face, and the damage limits won’t matter.now in tort, you would maintain your rights, so
if the contract was for say a warehouse, and the warehouse roof was bad, and the goods you kept in there were damaged, you could be limited to $500 in damages.
if the roof fell in and hurt you, you would likely have a claim for negligence
even though the lease limits your “Contract” damages, you would likely
maintain your “Tort” injuries.Now it’s a different legal standard.
Tort is about preponderance of evidence and breach of duty, while contract
ties to the reading of the letter of the agreement.so, if i haven’t confused you then i’ve enlightened you

Participantlook at the story, he was arrested at the airport by mclenburg county sheriff for
underage drinking and disorderly conduct.assuming the sheriff had jurisdiction, it’s an action by a county sheriff pursuant to state law.
I don’t get your question? The states regulate drinking ages, they regulate behaviour.
it’s usually a crime in most jurisdiction to be “disturbing the peace” or “Disorderly conduct” or “Depriving the general public of free use of the commons”. If the kid was drunk, it’s presumptive he was underage drinking.
more details may exist, such as if he was in possession of alcohol and drinking on the flight, or if air crew complained.
if you say something is unconstitutional it means :
1) The layer of government lacks that power or
2) The layer of government is depriving the people or another layer of a fundamental right.So to give some example, the Federal Government has the right to print money and the states are prohibited to print money. So if a state were to create California Credits, and to start printing and selling them, this would be
“Unconstitutional”. however, if a person were to create Satirical Arnolds,
to present as social commentary, this would be a first amendment issue.
So a prohibition of Arnolds would be a 1st amendment violation.So are you arguing the kid has some sort of constitutional right to get drunk?
