OT: I hate big governments, government overeaching it’s sticky hands

I heard about this story on the L.A. Times, but couldn’t find the original article. But here’s the details of what I was reading about.

Careful all you parents out there. Because them damn government social workers knows better than you do……

Serbian parents in custody battle

Last July in California, a Serbian man gave his work computer to an office technician it prompted a chain of events that have stripped him and his wife of their kids and sparked fury in his home country at the state’s child protective services system. The hard drive held at least 5,000 personal digital photos, and the technician noticed a few dozen pictures of the man’s two naked children. He reported the pictures to the sheriff’s office.

The father is a financial analyst, and has been a 20 year resident of the US, and attended college at Auburn University, and his wife were arrested briefly in July on suspicion of child molestation and pornography and released after prosecutors viewed the photos. The San Joaquin County district attorney’s office said it had no plan to file any charges unless new evidence came to light.

But sadly the story doesn’t end there. The two children ages 8 and 5, who are dual Serbian-U.S. citizens, were placed into protective custody, then foster care, where they remain six months later. The press won’t named the family due to the nature of the allegations. Now this case has attracted the attention of the Serbian government, and of local and federal law enforcement agencies here which so far have found no basis for criminal charges. But the state’s child protection system, with the consent of a judge, deemed that the children remain at risk and has kept them from their parents.

In December, The U.S. Attorney’s Office in Sacramento looked at the pictures, at the request of the Serbian government and decided that the son took the pictures, not the parents.

“Both the San Joaquin district attorney’s office and this office declined prosecution of the parents, concluding that the photographs were actually taken by one of the children,” U.S. Attorney Benjamin Wagner wrote in the letter obtained by the AP. Olympian

Yet Child Protective Services refuses to give the children back, saying there is new evidence that the father molested the little girl. The CPS produced a videotape, in which the girl says the father inappropriately touched her. Robert Powell, the father’s attorney said all that happened was that the father dried the girl off with a towel after a bath.

Janine Molgaard, an attorney for San Joaquin County’s Child Protective Services, said

“Whenever a case is referred by law enforcement to us, it’s our duty to make an independent determination if the children are at risk,” Molgaard said. “If continued care by a caretaker endangers them, if we believe it does, then we file a petition to the court.” Olympian

As a result, CPS is keeping the kids in foster care. Meanwhile, Serbians are outraged, and rightly so.

“There are indications of major human rights violations by the Child Protective Service, which is acting on its own,” Serbian justice ministry official Slobodan Homen told the AP. Olympian

Serbia is now providing attorney’s fees for the father and its Consul General in Chicago, Desko Nikitovic, is advocating on behalf of the couple. The couple denied to comment, and also deny the charges.

“The parents do not dispute that they (also) took photographs of their children without their clothes on,” said a statement from Powell, a San Jose-based attorney who specializes in child custody cases involving CPS. “However, not a single one of those photos was of a pornographic nature in any way. “They were commonly seen photos taken by parents of their children, such as in the bathtub and lounging on the couch.” Olympian

What the father did was routinely dumped all of his digital photographs into his work computer, had purchased an external hard drive and had given the machine to his office technician to make the transfer, triggering the custody battle. The children have not only been separated from their parents, but from each other and have been denied access to the family’s Serbian Orthodox Christian priest, unless the priest speaks to the children in English.

The children could not attend Orthodox Christmas services with them in Sacramento on Jan. 6-7, but that the court is now considering allowing the children to attend a Greek Orthodox church in the area. Meanwhile, the couple continue fighting for their children, and said through their attorney that the children have asked the mother during visits if they are abandoning them.

So what once was considered normal, taking pictures of babes in the buff now can get you arrested for child pornography, or molestation, your children taken away, and you can’t dry off your children if they are too young to do it themselves after a bath. Has society gone so far down the toilet, they see evil in everything a loving parent does?

A question for you flu.

Based on this sketchy evidence, I have no idea if the father actually committed any crime. Maybe he did, maybe he didn’t, but from what’s been presented, it certainly doesn’t appear to be sufficient to remove the kids from the home. But my question is this….what if the evidence was all but uncontrovertable. Actual photos of dad molesting the kids? Would that have been sufficient for you to believe the kids should be removed from the home?

The reason I ask, is that it seems to me that often when people assail big government, the actual complaint is about bad government. Maybe power hungry social workers. Maybe someone honestly believing, without good evidence that a crime has been committed. Smaller wouldn’t necessarily be any better. Fewer social workers on the street would just as likely to have dangerous egos. Or be so overworked that they just make mistakes. Should CPS not have the power to do what they do? Or should they just be better at it?

(And as an aside, if this government employee really is a social worker, she’s making much more than minimum wage. Social workers are trained medical professionals, and are reasonably well paid, although last I saw the pay scales, those working in the public sector are paid below those in the private sector.)
