Again “Failure to obey a lawful order” is on the books in most states.
I am not sure what the law says here but in most states the seperation point for this is “was the order reasonable”.
The police can not come up to and tell you to “shave your head and hop on one foot”. That is a unreasonable request. If you were arrested for not doing it… You just hit the lottery. You have a ligation point.
If there is a car on fire and you chose to stand 5 feet away and the cop tells you to stand 30 feet back and you refuse he does have the right to arrest you. The judge then has to discretation to determine if the cop made proper application… Guess what! The judge will most likely rule in favor of the cop and not your right to bonfire roast hot dogs.
