ParticipantOC –
I was under the impression that the bank already owns the home.
Whether or not you choose to pay your rent is up to you. Does it say somewhere in your lease that the owner is obligated to pay the mortgage?
I am not an attorney by any means so if your lawyer believes that you have a case then so be it. Once the property is returned to the lender then I am sure that between your lawyer and the lenders lawyer it will all get figured out.
In no way does it change my views on squatting whatsoever. Nor does it matter to me if there is a victimless crime or not.

ParticipantOC Scam it doesn’t matter to me how or why it is done. You want to classify it as a victimless crime then that is okay.
Look, I am not a big morality player type of person okay. I have plenty of missed opportunities in my life as well and watched many many people get plenty rich. It is what it is. It grates on me but I am not entitled to anything, period. Your original posting SCREAMED of entitlement and vindication; which is what prompted my response to you. Read your own post and tell me that if someone else reads it besides yourself, could they get the impression that I got?
Whether what you are doing hurts or does not hurt anyone or anything is not the question to me. It is not how any functional society could or should work. I think that you are by far the exception to the rule. I really do not believe many squatters take care of properties like you do and that there is much more indigent behavior that is associated with squatting then is not.
Fine if you are not exploiting someone then great; no I cannot find that exact person you are exploiting.
By your logic there is absolutely nothing wrong with ANYBODY finding foreclosed homes that are unoccupied and living in them. No victim right?

ParticipantGenerally a listing agreement is between you the seller and the broker, (brokerage). All agents actually are under the employ of the broker. So the listing agent may have signed the agreement, however the actual listing really belongs to the broker. (An example would be if that agent went and left the brokerage, the listing would still belong to the broker/brokerage, and would not move with the agent to the new brokerage unless she received permission from her original broker to take it with her and give it to her new broker)
If you are unhappy simply call the broker up and ask the broker to go ahead and have the listing agents name put on the MLS listing because you were under the impression her name would be attached to your listing, not somebody on the team.

ParticipantHi BSR –
There is nothing legally binding about the words “as is”. Additionally the lenders don’t want to deal with the entire transaction process, documentation etc… It all presents more work/liability for them. Even with that said, when you buy an REO property you are presented with a stack of private paperwork from the lender that is all release of liability, things like mold, termites, even general disclosure. The lender never lived there so they really cannot disclose anything about the property.
When will they become truly motivated?
The sooner the better!! I guess each lender decides for themselves when they should get off the pot.

Lets review what you originally posted.
“I’m a legal squatter and feel nothing wrong about living in my home rent free! If these lender are stupid enough lend money to a girl that is a single mom with two children, no assets, money and job??? Then hell I will live here and add the monthly rent to my savings I have been putting away for 10 years as a renter. Which is now closely matching a good 20% percent down as prices decline.
As a legal squatter I’m having the lawn cut weekly, watering the grass and taking care of the plants and roses. Home is cleaned everyday windows are wiped. In fact the other day I had the outside of the home pressure washed.
For years I watch people make thousands on homes they bought for a month. Now I can handle a little free rent!”
So from the text of your post, especially the last line, you make it sound as if you are vindicated in some manner because of the events that surrounded you. That you are entitled to not pay any rent because events occurred that were certainly beyond your control. That is fine, evidently you do indeed feel vindicated.
Even your last line of your most recent post,
“Hey I will get my one year either way.” screams of entitlement for you due to the situation you find yourself in.
You are keeping the house up and that is great. That differentiates you from the bums who move into homes and squat in them and don’t keep it up at all. Please don’t rationalize the situation by saying you pay rent to yourself. You do not pay rent. You are taking advantage of the situation that has presented itself to you and living off the lenders dole. As I said, I have no sympathy for the lenders. Do what you want, move out or do not move out, it is up to you.
I simply do not agree with squatting. Those people that you watched make thousands on real estate, it is not their fault you are in the situation you are in. They made money, you did not, I did not, others did not. Don’t blame others for opportunities missed.
Live your lifestyle and enjoy it. It is not what I would nor what I would ever advocate.
