ParticipantCan you prove you were infected by the food at that specific restaurant? In other words, did a government health dept. find evidence of the causative agent in the food at that restaurant? If not you are unlikely to have a case. People get sick all the time – and often it is impossible to know how the disease was transmitted.

ParticipantNazzy – we live in cv, and have been through very similar to what you are talking about. First of all, don’t always believe what the seller’s agent tells you. Things are so crazy right now they can say anything and be believed. On the other hand, i know there is a lot of competition. Is it possible for you to let things die down and start looking again in September or October? The competition dies down, and prices also come down (a bit). Because CV is so geared to education, everyone wants to close before the school year starts, and I think sellers get a bit more reasonable in August, Sept. You might be able to rent an apartment short term/month to month in Torrey hillls so that you have residency and can register your kids for school in the fall (although they may have to change elementary schools once you buy). it might be pricey but probably less than a mortgage payment. There are a few tricks to the school registration thing when you are in transition – PM me if you are dealing with that and want my 2 cents. Finally – remember that buying a house is always miserable. CV is a great place to live and eventually you’ll be done with it.

ParticipantBG – you ask whether I’m still in NJ. I indicated earlier in this thread that my son will enter CCA this fall. Apparently not financially secure enough to have time to pay attention to what other people write . . .

ParticipantNazzy – in terms of what not to be influenced by, I would add that bearishgurl has a case of sour grapes that almost borders on hallucination. There are a lot of other more reasonable posters here, though, who have raised many good points.

ParticipantBG – you entirely ignored my point, and my point was that when you use quotation marks (and you use more than anyone I have ever encountered) you should actually be quoting someone.
I now have a second point – when you purport to quote ME never, EVER, change what I have written. You added italics where there were none. The italics don’t change the meaning on the quote, but they make me look stupid, as the italics have no use where you have put them. If you wish to appear melodramatic in your own writing, that’s up to you. But if you quote me, use my words as I have written them.

ParticipantBG – I searched this thread and no one ever said anything about residents being “of color.” From what I can tell you are the only one to use that phrase.

ParticipantI would think that since the seller was unable to close (as they were contractually obligated to do) they would be liable to you for the damage that you sustained. Unfortunately that would require you to sue them and they appear short of cash. BG is right – your agent should have found out a bit more about this, but I think the SELLER’S agent is even more culpable. Probably doesn’t rise to the level of an Error or Omission (which agents are insured for), but I would look into it.

ParticipantMy son will enter CCA this fall. I have been told (although I have no hard data) that there were a significant number of freshman at Torrey Pines HS who wanted to transfer to CCA for sophomore year (and beyond). So your assumptions may be off –

Moved there in 2007 for a job – missed San Diego enough to leave a secure job in NJ to return here in 2011. And yes – most NJ homes predate the HOA trend, but neighborhoods are also less consistent there.

ParticipantTo the extent you accept that an HOA is necessary at all, I think you are right. But I’m not sure that they are necessary. We have lived in two homes in SD without HOAs and one that had an HOA (the one with the HOA had a lot of rentals for UCSD, etc.) We never wished for an HOA when one didn’t exist. And the one time we did have to deal with an HOA it was clear that the board was interested in handing out maintenance contracts to friends. So the interest in upgrading things for resale value I think is simply a ruse.

Specifically, race cannot be a proper cause for exclusion from jury pools. Sex can. Education can. Age can. See Strauder v. West Virginia:
The very idea of a jury is a body of men composed of the peers or equals of the person whose rights it is selected or summoned to determine — that is, of his neighbors, fellows, associates, persons having the same legal status in society as that which he holds.

Only partially right. The constitution doesn’t mention “jury of your peers” specifically. But the SCOTUS has. And since the SCOTUS is the final word (at least until they change their minds) on what the constitution does and doesn’t say, “jury of your peers” is now the law of the land.[/quote]
You’re entitled to a fair cross section of the community where the court convenes – not peers. For example – my peers might be lower middle class white women. Do you really think thats the jury i would get? I dont believe there is any Supreme Court case where there is a holding (not dictum) where it was found that you’re entitled to a jury of your peers.
