ParticipantThe ruling is based upon whether the person who is trying to repossess can prove that they really hold the loan, particularly if they are not the entity that originated it.
MERS has no standing because they don’t own it.. unless they are being paid to ‘service’ the loan, at which point they do. The problem is.. can MERS prove that they control that loan (paperwork trail?).
During the real-estate madness heydays.. I don’t think that many people were keeping the paperwork in order.

The ‘proper’ accesses are located at the east and west end of Calle Cristobal. The west end is located at the south side of Calle Cristobal at the bottom of the hill (large parking lot with a gate). The east end is supposedly at the park located at the north end of Camino Ruiz (intersection Camino Ruiz and Calle Cristobal). I have not checked the access from the park yet. It is possible to mountain bike from the west access, heading to the east – all the way to 15 and past by a bit.

ParticipantIt is interesting to note that increasing down payments is similar to what was done by the SEC after the great depression with respect to margin on investment accounts. Prior to the great depression, margin accounts were almost unlimited on the amount of margin a person could assume. After the great depression, the percentage of total assets you could have out on margin was limited…
Requiring 20% down for owner occupied, and 30% down on investment property sounds reasonable.
