I am in a house that was purchase for way too much with nothing (5%) down on an ARM that is going to adjust soon. Needless to say I am just waiting for the call to come. Nothing yet on foreclosure.com though.
Worst past is the owner is a mortgage broker with Downey Savings. I don’t even know if he is still employed.

The landlord is required to pay the mortgage while collecting rent from the renter, right ? I think sakina96 have some legal recourse regarding this matter.

Does anyone know how up to date the county assessor’s site is? I can always go downtown to the county bldg and check, and sometimes I do this. Yesterday morning there was a notice of auction for a unit in my bldg on another unit which has tenants in it. I wonder if the owner of that unit bothered to notify her tenants. How does the bank handle this situation? Doesn’t the bank have to give the current tenants 30/60 day notice? And are they obligated to return the deposit to the tenant?

I would stop paying the rent with the reasoning that I no longer know who the legal owner of the property is. Put the rent money aside in a separate account and have it ready to pay the rent if needed. And to show your good intentions if a court orders you to pay.
What is the landlord going to do? He won’t even bother to evict you because he’s losing the house himself.
Consider the rent “savings” compensation for all the trouble and worries.
