For the last 2 weeks I have been dealing with a crazy situation. On the morning of July 27th I get a call from some realtor who said his client just bought one of my short sale listings at the trustee sale. I tell him we track closely and nothing has ever been filed against the property but he is indignant and insists I cancel the listing so he can re-list it for his client and get it sold.
I explain I know what I am doing and that he better be certain he owns it. I then contact my title rep who confirms that no NOD was ever filed and we contact the executive offices and legal offices of the lender who also confirm this. The realtor calls again and is telling us to get out of his way but I ask him to please prove that they actually bought this unit. The numbskull disappears for several days and comes back with his same demands again but no proof. I explain we have no indication they are the owners and again ask for a trustee sale receipt for the property. he promises to get it and disappears for another week not returning calls or emails.
The buyer we have for the unit really wants it and is dying to get it re-approved (it had been approved at same price for a prior buyer) and his agent is calling constantly. He goes over to show the unit to his sister and someone is there cleaning the unit and painting the unit. He freaks out wondering if it got foreclosed upon. I contact this numbskull again and explain that they may not own it, if they do will likely be in a lawsuit, are probably criminally trespassing and shouldnt be wasting time or money fixing up a unit they dont own.
The buyer is of course freaking out and we have no idea who owns the unit and whether it was foreclosed upon but everything we look at says our client still does. Two days, I send another round of emails and phone calls to the agent begging him to get me a receipt. Really…..how tough can it be to get a trustee sale receipt? Its been two weeks!! Please do your job and verify your client owns it. I say if your investor owns it I will put him in touch with a great all cash buyer for this property which is tough to sell because owner occupancy in the complex is 40%. I say I will step aside and let them put together the deal themselves. No response so I leave the message again yesterday.
Tonite I am giving my kids their baths and the phone rings, its this agent so I let it go to voicemail. 10 minutes later the phone rings again and its him so I let it go to voicemail again. I finish the kids baths and sit down to listen to the voicemails.
First voicemail-I am on my way to get the receipt (its been two frickin weeks!!!) and I will fax it to you. We need you to cancel the listing immediately and get out of our way. We do this all the time and know what we are doing. We dont care about your buyer. Just get out of our way, get your lockbox off the property and let us get this done. (In a word he was indignant).
Second voicemail-Oh my God! I am so sorry! Please call me asap.
Phone Call – Hi BP, this is sdr what’s up. Oh my God sdr, I am so sorry I just got the receipt and we had the wrong apn number. We changed the locks, cleaned and painted this unit we dont own. You were right. Please dont sue us. I am running there right now to put the keys to the new
I am rolling on the floor laughing!!! So this is the incompetence I deal with on a daily basis. Someone bought a unit and didnt bother to check which unit they actually owned. Their lazy, incompetent agent took over 2 weeks to figure out that he was directing renovations over a property they never owned, was criminally trespassing, spent a couple thousand dollars and has incurred great liability on. I just laughed at him as he was already completely humiliated. Of course, I have to tell my client who happens to be an out of work attorney. Wonder what she will want to do?
