Article 1 section 8 is the discussion on the Federal GOV’s authority. Everything starts there. Article III is not applicable before considering Article 1.

It CREATED a GOV authority in an AREA not authorized by Article 1 section 8! Why isn’t this clear to everyone?!
All laws start with the Congress in the Constitution and the legislative branch in article 1 section 8. IF THERE IS NO AUTHORITY IN THAT AREA THE SUPREME COURT RULING IS UNCONSTITUTIONAL.

I’m really not trying to pull rank on you. really. but i did go to a top 20 law school, graduated at the top of the class, got the 2nd highest grade in con law.
we had conservative profs and liberal profs. often you couldn’t tell which was which. they were all hardcore scholars who questioned you hard and made you question what you thought you knew.
That said, I’ve forgotten pretty much everything.
but.
I remember that it’s not so simple.

I know Sec. 8 is pretty important to Ron Paul. I think he would be pretty embarrassed the way you’re throwing it around.

I once was threatens with sanctions for using a larger font size in my youth in a portion of a motion. The court felt I was contemptuously yelling at it.
I ultimately wasn’t sanctioned but it was only due to my incredible ability to grovel and beg and apologize sincerely.
