Could the state invoke eminent domain here? If one party isn’t paying and the other party can’t prove they own the loan, can the state step in and seize the house. I’m sure the taxpayers effectively own the house anyway, so I’d like to see the government step in here and take the property.

We have seen the gradual erosion of private property owners rights and emminent domain seizures are pretty darn scary nowadays.
As more and more movement of mortgages, securitization and such, this is becoming a real problem. It will be interesting to see how it plays out.
