A few weeks back one of my clients sold a home in a gated community in north county. I noticed that the cost of the HOA/CCR doc prep was a few hundred dollars more then usual. When I queried the HOA it turns out that they had a seperate inspection where they actually sent out an inspector to make sure that the sellers home conformed to CCRs.
That “additional” inspection cost the seller an extra $400. The HOA justification was that this inspection would actually protect the seller because the HOA had said there were cases where sellers made changes to homes that did not conform to CCRs and when a new owner came in, the new owner was immediately slapped with a violation notice. The new owner would then hold the previous owner liable.
My point in posting this is not to argue whether this is good or bad… (IMO the fact that the HOA sticks people with a few hundred bucks to have someone come out and do a 15 minute inspection stinks) Anyways my point is that if you are purchasing a home in a community with any HOA or CCR you may want to put in the purchase agreement that the seller must get this inspection done IF the HOA provides for it…. just fyi…
