Question about flexible spending accounts. You may know that FSAs require that you guestimate your expenses for the year, and then you lose what you don’t spend. On the flip side, your account is pre-funded and if you quit your job you can use the full election even though you haven’t had the money taken out of your checks yet. EG: If you elect to have $2,000 pre-funded, you can get eye surgery in Feb., then quit your job in March. If the cost was $1,500, but you have only had $200 taken out from your pay so far, you will literaly get the $1,300 for free. Question: This is the actual policy of the program, and it makes sense considering you are also taking the risk of losing money. But, if you were quitting your job would you take advantage of it and would it be ethical if you did?

I don’t know if the policy is per company, but for mine, in the scenario you describe, you would owe $1300 when you quit. It was previously “free” money but the policy was changed in last year I believe, probably because of abuse.

I wont have to pay back the amount that I go over, and I only elected $1,000 for the year. The more I think about it, the less I feel that it is ethically wrong to just use the balance even if I plan to quit. This account required that I take on substantial risk including the possibility of losing end of year money which actually happened to me 3 years ago. Also, another risk is that they require you to use your entire balance for the year by your last day of work. EG: If you give a two week notice on Oct. 1st, you would have to use or lose your entire balance withinn two weeks. Under the dependant care FSA you have the rest of the year to file claims up to your balance amount (not pre-funded), even if you have left the job. Can’t say that this program makes a whole lot of sense to me, but the rules are the rules. Even in the emaail they sent me this week, they stated that I could use the entire balance under these rules and a service agent I spoke to encouraged me to do so. Stupid rule, but when they created it they did so with the full understanding that employees also stand to lose money under these FSAs. If they didn’t want people to use unfunded elections they could have written that into the rules, but they didn’t.
