Why not focus on the REALTOR wife who probably told him that “everybody else is doing this and getting away with it…they can’t do anything to us.”
Of course, he should be held to a high standard as a police officer, but what about her? She’s the one involved in real estate on a day-to-day basis. I’m not sure why they’re just focusing on him. Hopefully, she will lose her job as well…but we all know that won’t happen.
This is exactly what I’m talking about in the “public servant” threads when I say that public employees are held to a higher standard. People in private industry have been trashing their (soon to be foreclosed) houses for years; it’s only because of his job in public service that he’s being torn apart in the media.

October 8, 2010 at 7:44 AM #614568CoronitaParticipantI’d like to see someone get prosecuted just to see show that 502.5 can be enforced.
It sucks to be these folks, since as some say other have done it, but someone has to be made and example of….And considering he’s a cop (or was), perfect example.
Don’t feel too bad for this cop (hopefully ex-cop)…. we tax payers are probably still paying him a salary while he’s on administrative leave….You know how unions work… Fvckup, still get paid while they do an investigation until you get terminated (if you are unlucky to get terminated at all)…
502.5 is a very interesting penal code. I’d like to see it be put to the test.
Every person who, after mortgaging or encumbering by deed of
trust any real property, and during the existence of such mortgage
or deed of trust, or after such mortgaged or encumbered property
shall have been sold under an order and decree of foreclosure or at
trustee’s sale, and with intent to defraud or injure the mortgagee or
the beneficiary or trustee, under such deed of trust, his
representatives, successors or assigns, or the purchaser of such
mortgaged or encumbered premises at such foreclosure or trustee’s
sale, his representatives, successors or assigns, takes, removes or
carries away from such mortgaged or encumbered premises, or otherwise
disposes of or permits the taking, removal or carrying away or
otherwise disposing of any house, barn, windmill, water tank, pump,
engine or other part of the freehold that is attached or affixed to
such premises as an improvement thereon, without the written consent
of the mortgagee or beneficiary, under deed of trust, his
representatives, successors or assigns, or the purchaser at such
foreclosure or trustee’s sale, his representatives, successors or
assigns, is guilty of larceny and shall be punished accordingly.

October 8, 2010 at 7:54 AM #614583jpinpbParticipantThanks for posting the code, flu.
Now let’s have the laws be fair and start filing charges against everyone who does this, instead of picking and choosing one guy b/c he’s a cop. Not saying he shouldn’t be charged. He definitely should, as all the others. No one should get away w/this and too many people have.
I don’t like that they’re targeting him b/c of the fact he’s a cop. Media making a big deal about it. All the headlines read “Cop.” Wasn’t the wife involved w/this? How about one friggin’ headline that reads “Realtor” destroys house.
In the end, he is human like all the other FBs. They are making a big hoopla b/c he is a cop. That doesn’t make him above the law, but it doesn’t mean he has to pay while everyone else skates.
The law should be applied fairly to everyone.
