Tone, In regards to the foreclosure, I was involved in a convoluted mess. I knew something was up when the landlord started getting letters from attorney’s and repeated letters from the HOA delivered to the house I was renting. They never put a forward on the address after they bought it. My suspicions were confirmed when a broker showed up at my door with a list of NOD’s in his hand and my address was on that list. He wanted to talk to the lady of the house and thought I was her.
The owner was being foreclosed on by the first mortgage holder, then his mother bailed him out with a second from her company and she had to start foreclosure proceedings on him because he stopped paying on the second. I woke up one morning to Fed ex at my door delivering an “assignment of rents” from the second mortgage holder (his mommy). His mother demanded I pay HER. He demanded I pay HIM. I was caught in the middle and knew I had to go. I stopped paying him because I knew I wasn’t getting my deposit back, and left.
When I first confronted him about the situation, he lied to me, telling me it was all a misunderstanding. Then I found out the taxes weren’t paid on the property and the HOA association dues weren’t being paid-the HOA put a lien on the property. The bottom line was he couldn’t afford the property and he was doing his mother dirty by letting the second foreclose.
I don’t know what he was doing with my monthly rent check, he definitely wasn’t paying the mortgage.
