I wonder if there’s a lawyer out there who would be willing to pro bono (for publciity maybe?) take on any potential lawsuit with a large contngency arrangement on a potential counterclaim. While it’s generally true that lawsuits are costly and the parties generally bear the burden of their costs, the threat of a counterclaim, particularly in a spurious lawsuit, might make people hesisate before suing without a lawyer. And if you’re a lawyer, and it’s a dopey case, unles you’re getting paid 2-300 an hour, you probably wouldn’t wanna risk your bar card pursuing an unwinnable case on the cheap. Talk to some lawyers, maybe in the real estate field who are suing mortgage brokers or similar work, maybe they’d take it on.
