This probably will not happen where you are looking, but we had a 20 year flood 2 years after we moved in(we live near Jamul). This flood washed out a secondary bridge and we had to sue the builder to build a new one. Well, there were three builders involved, so the attorneys won that one. I would check and see what kind of insurance the HOA carries. We were also assured when we moved in that the monthly dues would come down when it was built out and that has not happened either. We have been here 14+ years. Perhaps someone with a legal background can explain how to hold them to their promises….
