Talk to any prosecutor. The crime is the crime and comparing to a hypothetical is no defense.

Not all speeders get stopped and fined. Some speeders are stopped so that they can be made examples and so that other drivers don’t speed.

If we can make an example of the guy who doesn’t pay his firefighting fee (by letting his house burn down) then why shouldn’t this cop be made an example of?
