When I put in an offer on one of the units a while back, my realtor spoke to the LA. Stated that some banks were willing to finance. Actually had a list of banks for me to speak to if the one I was working with wouldn’t finance.
HOA litigation is due to Paradee’s roof construction. My argument was that my unit was on the first floor and didn’t really have a roof. =)
Looks like both of them are upstairs units. I would actually be more afraid of street noise if its facing Poway. The units I saw got pretty noisy but I think #28 might be set back far enough to not be TOO much of an issue.
If you are worried about noise, the best thing you could do is spend some time around there. I think that other threads in this forum will give you arguments showing either side of the “noise” debate.
Go in the unit. Open the windows. Sit out in the patio. Listen.
