toddt, I believe what you may be referring to is a “Modified Trust Deed” or “Modification of Trust Deed.” I have seen two of these in recorded instruments and they were both modifying the terms of a HELOC. I, too, would like to see any modified terms of a TD recorded. This should be mandatory.

So at this point there is no formal process or system in place for these to be recorded, nor is it happening, which is VERY unfortunate…
Someone once mentioned that recipients of principal reductions will more than likely look to get their property taxes re-assessed after the loan mod. This might be a way to understand more of the history related to the property. So, if you can pull records at the Assessors office, that may help.
Through this thread I am hoping we Piggs can come up with as many possible ways to find out these “mods”, so we have full disclosure (or as close to) before entering a transaction.
Any other ideas?
BTW SDR, I like the term “shadow comp killers”.

May 10, 2010 at 12:07 PM #549456NotCrankyParticipantI wonder to what degree loan mods will be tied to bankruptcy filings? Following bankruptcies may be a round about way to get some information?
