The bank is powerless with regards to the tenants and wont do anything. There simply is no mechanism for them to do so.
I am assuming you are buying the home as a principal residence. If so, I would not close or allow you loan to fund until the tenants are out of the property. its the sellers responsibility and you dont want to get stuck with holdover tenants. Isnt your agent advising you to do this? If not, you probably havent hired the right one.
