You probably have at least 3 months before receiving a NOT, Notice of Trustee sale…the sale will be 3 weeks later..
After the sale, I believe that the current CA law is that a tenant has at least 60 days after sale to vacate…You won’t have to move anytime soon….
Paying the landlord is a different issue. If they have a security deposit, I would IMMEDIATELY use that as rent and not allow them to have any deposit.
I seriously doubt that they will serve you an UD.
If the property was purchased as a rental property, they probably signed an “assignment of rents” which means the servicer can come to you to collect rent.
If they converted a former primary to a rental they would not have signed the assignment…HLS

I understand the terms of my lease, but it’s galling just the same. The security deposit tactic will work for the last 2 months, but that still leaves Feb and March rents that I have to pony up.

As for the “assignment of rents” I know this place was purchased as owner occupied, as I’ve seen the original mortgage terms on a refi offer that was addressed to me. In addition, the landlord must have tried to do a workout with the bank(s), as we have had 2 mortgage company investigators in the past year inquiring if the home was indeed “owner occupied”. I politely informed them that is was not. Looks like my landlords are just more Trump wannabees who lacked the sophistication to know what they were getting into.

I have had numerous converstaions with tenants about your situation. My advice would be to use your training and restrain yourself.
You probably know more about your legal rights than they do. I would keep my cool, but INSIST that your 2 month deposit gets used for FEB & MARCH…
You tell them that you are afraid about getting kicked out soon, and that you will never get your security deposit back from them. (They may be clueless)
AFTER Feb & March are done, tell them that are not willing to pay 100% of your rent. You will do THEM a favor by paying 25% of the current rent, and they can have some money in their pocket rather than having the property sit empty..
KEEP YOUR COOL, come from a position of power. NOBODY is going to move in if you were to vacate (which you don’t want to do) anything that they get will be a bonus to them…
Play your cards right and you will be there for another 6 months and be paying very little.
When all is said and done, feel free to send me a check for 50% of what you saved. My address is available upon request π
