Well I have certainly enjoyed reading people’s post and learning about economic issues that I hadn’t educaed myself on in the past. If I knew what I know now, I certainly wouldn’t have been a sucker 3 months ago and purchased a house. What’s done is done…Anyway, I posted about a month ago with the issues related to buying a house at this time in the market, I also wrote about some of the issues the property has and a couple of you mentioned speaking to an attorney. Basically I am asking if any of you know a decent (ha)attorney that specializes in small real estate issues. Bascially we had the house inspected prior to closing and nothing “big” came up. After we moved in we had some plants removed that were too close to the house. Removing the plants exposed major water damage to the stucco due to the sprinklers hitting the house, which has also caused a moldy smell in almost all the exterior walls (you can smell it through the electrical outlets). You might say that we the buyers should have looked more closely, but I think the the inspector shouldn’t have missed this. And I can’t believe the previous owners weren’t aware that this was happening. Any thoughts? If you know of an attorney, I’d really apprechiate his/her contact info. Thanks

I don’t know any RE Attorneys. But I think it will be difficult to prove that they knowingly withheld this information on the disclosure. What is easy for them to find is also (theoretically) easy for the inspector to find. I think you would have to prove that the sellers knew about the damage and failed to disclose it.

We sold our house, and I would hate to have someone come back to me after the transaction is done and ask for thousands of dollars more for something I don’t own anymore. Not trying to bash you, but I’m not sure what you can do if your due diligence failed to produce this damage in the first place.

He missed it and now we are stuck with a 10,000 bill for repairs. Oh the joys of homeownership. We are just trying to figure out what to do, either just eat the cost or attempt to get some of the reapirs reimbursed by the inspector with the assistance of an attorney.

Like you’re probably going to do, it wouldn’t hurt to get that attorney to send over a notice saying that major damage was hidden, and has a $10k repair bill. It might scare the sellers into coughing up some money. It was definitely stupid of them to water the house!
