Sorry, but I’m with SD_R on this one. There is legal and then there is right. One of the reasons we are all going to be having problems going forward is because of people who are taking advantage of the weaknesses in the system. Finding and exploiting a loophole at someone else’s expense isn’t right regardless of how it’s done.
You’ve offered your rent receipts to the lender, which I think is commendable in itself. They haven’t responded so far, probably because they have no right to those rents until they take the property back. No response isn’t the same thing as refusal. If after they foreclose they still decline the accrued rents to offset their other losses then I’d say that on an ethical basis you’re in the clear to keep them. Other than that…..

As a legal squatter I’m having the lawn cut weekly, watering the grass and taking care of the plants and roses. Home is cleaned everyday windows are wiped. In fact the other day I had the outside of the home pressure washed.
For years I watch people make thousands on homes they bought for a month. Now I can handle a little free rent!”
So from the text of your post, especially the last line, you make it sound as if you are vindicated in some manner because of the events that surrounded you. That you are entitled to not pay any rent because events occurred that were certainly beyond your control. That is fine, evidently you do indeed feel vindicated.
Even your last line of your most recent post,
“Hey I will get my one year either way.” screams of entitlement for you due to the situation you find yourself in.
You are keeping the house up and that is great. That differentiates you from the bums who move into homes and squat in them and don’t keep it up at all. Please don’t rationalize the situation by saying you pay rent to yourself. You do not pay rent. You are taking advantage of the situation that has presented itself to you and living off the lenders dole. As I said, I have no sympathy for the lenders. Do what you want, move out or do not move out, it is up to you.
I simply do not agree with squatting. Those people that you watched make thousands on real estate, it is not their fault you are in the situation you are in. They made money, you did not, I did not, others did not. Don’t blame others for opportunities missed.
Live your lifestyle and enjoy it. It is not what I would nor what I would ever advocate.

Once the home goes into official foreclosure (It is held in Bankruptcy court right now) and the bank contacts me I will and plan to cooperate fully and peace fully. There is nothing wrong with that!!

I am lost right there. What do you mean by that? Are you living there beyond lease period without paying rent? Do you have a valid lease and just stopped paying rent because the house was foreclosed? If you just walked in after the house was foreclosed because you found the door unlocked, that won't be legal, right?

August 28, 2007 at 10:45 AM #82172betting on fallParticipantI think the real danger is if enterprising crooks (or out of work contractors) go into these homes and steal copper pipes, sinks, faucets, wiring, etc. I am sure several thousands $$$ of stuff can be ripped out of a home and sold pretty easily. It then would be far more expensive to replace it, and I don’t see the banks being too excited to pay for it.
