If you are not a licensed agent and a member of the local board the agent was correct. Whether you use an agent or not, the listing agent is entitled the full commission and only pays out to another cooperating agent if you are represented by one. If you go in alone and decline to have the listing agent represent you, then he is entitled to all of it.

He currently has:
150 active listings in SD County (most of which are short sales with offers on them)
115 contingent listngs in SD County (short sales with offers on them)
51 pendings (should be mostly approved short sales)
20 Closed short sales in the last 90 days in SDS County
Having consistently carried over 200 short sale listings for the last 2 years, his pipeline should be very full and the his monthly closing should be very representative of what results they achieve.
Averaging 7 closed sales a month with a couple hundred swings at the ball speaks for itself.
