I would highly recommend that everyone do what I did… FILE A COMPLAINT WITH THE BBB of San Diego. If he gets enough complaints he will lose his BBB accreditation, and that is the slap in the face that this guy deserves.
[/quote]Don’t expect much from the BBB. BBB is paid by the businesses, not the consumers… so they give the businesses a chance to justify/rationalize why the complaints are invalid… If the business has a good schtick – BBB will not post the complaint. Why would they – that would hurt revenue. File the complaint, but don’t be optimistic.
That said – realtors and brokers are licensed by the state and have to follow various business practices… If you put in a complaint there – it will also probably be ignored… unless you have proof and are a squeaky wheel… Some underfunded overworked beaurocrat has to investigate.

But keep in mind – they’ll only investigate if a RE law/code was violated.
http://www.dre.ca.gov/pub_relaw.htmlIf you just want to spread his bad reputation – considering filing a report like this…

January 13, 2010 at 12:37 PM #501853AecetiaParticipantI agree with the comments about the BBB, even in a case where the conduct bordered on senior fraud and the company lied about having done the remodel until their logo was located in the cabinets. They never gave an estimate and the work was shoddy. BBB basically kissed it off and I think they are a waste of time. The questionable conduct would have to show up on an expose before they would take any action.

March 10, 2010 at 3:59 PM #524141SellingMyHomeParticipantSo, we just sold our home as a short sale through Battiata. We listed in early November, got bank approval in late January, and closed March 8th. Pretty fast!
Like some people here warned, Battiata’s team was out of touch and weird to deal with. Their experience dealing with short sales is the reason to go with them. They know how to deal with the banks.
I asked the buyers agent how it was dealing with them, and the agent admitted it was not easy at first.
I would recommend them to anyone selling a house that is underwater. I would not recommend them if you are the type that needs your hand held the whole way. You must be proactive with them. When we are ready to buy in a few years, I will definately look for another agent.
Thanks for all your help!
