Just found out this week that the house we were originally trying for sold, and the offer they took was $52,000 LESS than what we offered. This means they DEFINITELY do not go with “best and highest”. I would be interested to see if there was a second realtor on the deal or if both sides were represented by Battiata (which means he got both ends of the commission).

I feel bad for the sellers because they will have to pay the taxes on that $52,000 difference since the government considers it Income when dealing with a short sale.

I would highly recommend that everyone do what I did… FILE A COMPLAINT WITH THE BBB of San Diego. If he gets enough complaints he will lose his BBB accreditation, and that is the slap in the face that this guy deserves.
