Then again, we’ve had executive and judicial action increase rights recently:
(1) Right to marry whom you want to in all states. I’m not gay, but many of the arguments used against gay marriage were the same as were used against interracial marriage (a strongly personal issue for me) 50 years ago.
(2) Recent DoJ action to restrict state and local governments from excessive bail, based on income. They’re finally taking the Constitutional prohibition of excessive bail literally.
(3) The trend of restricting civil forfeiture by states.
(4) The gradual emptying of Guantanamo — holding people in limbo without trial is generally a bad thing.
(5) The end of stop and frisk, and the censuring of city police departments (Baltimore) by Federal courts.
