This would theoretically work in CA, patb, if the “enterprising tenant” made sure to start putting their stuff in storage on the notice of sale date (is paying attn to foreclosure process) which will have a sale date of 20-30 days out.
Ideally, after the Notice of Trustees Sale is filed, the “enterprising tenant” should be looking for another rental which has been defaulted on (that they can squeeze another 3-24 mos on), lol! After all, they’ll have a handsome “deposit” saved up from not paying rent!!
The tenants’ don’t want to be standing holding the bag (literally speaking) while the sheriff deputies give the family 30-45 minutes to vacate before they bolt the door shut.
Regardless of if the sale is postponed, the “enterprising, squatting family” should have their duffle bags, sleeping bags air mattresses, ipods, laptops and cell phones ready to roll when the time comes and should be packing them in their car every morning after the trustee sale date if they go to school/work during the day.
Law enforcement contract moving and storage fees can be VERY high :=]
