The banking industry is full of scammers and scams like this. Nothing got cleaned up, it was all just temporarily swept under the rug.

“No prepayment penalty” seems pretty clear, I can see lots of smart folks not bothering to assume a lie and notice that *. There is an advertising law against shouting a lie and whispering the truth, seems like this violates that.
Expect to read about more and more of this stuff. The big banks are insolvant, they are desparate, regardless of what the MSM says.
Now get out there and outbid someone on the one or two REOs (out of the thousands they have) they put on the market, you savvy RE investors you.

Sure if you find another bank with an equal or lower rate, than I would say this is an issue. But if this bank is offering the best rate you can find, I’d say it’s a moot point. If it principle really matters, and this big bank is a lowest rate, then get the other loan out of principle…
Since when do you really see anything in America truthfully represented without reading the fine print? If there’s any doubt, just turn on late night tv and watch all the infomercials. Buyer beware…No difference from what we have before.
