Then we’re saying the same thing. The dude had his foot on the brake. The car failed to stop. Failing to stop caused the accident.
There is no weakness in those statements.

The Lexus they were driving doesn’t have the kind of power necessary to do that and the brakes weren’t drive-by-wire. I’ve got a 505 HP corvette and I cant overcome the brakes on it. (Yes I’ve tried, just to see how much tire smoke we could develop.)[/quote]
