OT: father is visiting and hospitalized by stroke

I don’t think that the affidavit of support (I-134) gives any rights to debt collectors. It is a document in which the sponsor promises to ensure that the visitor does not become a “public charge”. It is not a broad agreement to pay all their bills.

The real danger is that, when you told the hospital that your father had no insurance, they may have asked you to sign a paper that you’re financially responsible for him. If you did that, you’re screwed.

I am not a lawyer and this looks like a situation where you might want to consult one.

Foreign visitors from many countries can get visitor visas to USA, on their own, without an Affidavit of Support from a resident.

The Affidavit of Support is just to deter the alien from becoming a public charge (welfare, food stamps, medicaid/cal, etc…).

When it comes to private debts… that’s between the lender and the borrower.

Never conflate and confuse the issues.

Of course, private hospitals get money from the government for services to the indigent … but that’s another issue.

No question – you need legal help on this. Too complicated for even the Piggs here, I’d say. When one guy says you can ignore the bill collectors and another guy says you may have signed some document that makes you liable, then you need professional help.

I’d recommend calling some law offices that specialize in something other than this and ask them for recommendations of good attorneys that do specialize in this. I don’t even know what “this” is.

I believe that the papers that you signed is just next of kin authorizing care. They are not financial responsibility forms.

If a bill collector contacts you who claims that you owe money, ask him to produce the contract.

BTW, this has nothing to do with your dad being a visitor from abroad. It can happen to anyone here in America who is not covered by insurance (private or public).
