Federal prosecutors say Araya and his co-defendants sent homeowners facing foreclosure hundreds of thousands of “deceptive and misleading” mass-mailers that offered help with the government-run Home Affordable Modification Program.
In the mailers, the defendants falsely claimed to be either a nonprofit or affiliated with the government programs. Prosecutors say the defendants asked the homeowners to send them “reinstatement fees” and “trial mortgage payments,” which they claimed would be used to modify the homeowners’ mortgages.
