    Hi,

    I came across this discussion in one of the listserv I belong to and thought it would be something worth sharing with this community. Were many of you aware of this before? What are your thoughts?

    “According to CEB Mortgages, Deeds of Trust, and Foreclosure Litigation, Federal Law permits the United States government to recover
    (deficiencies) from borrowers on FHA-insured or VA-guaranteed loans under the theories of subrogation and indemnity. See, e.g. 38 CFR 36.4323(e). These provisions override the protections of CCP 580b. Similarly, federal policy considerations override CCP 580d. Branden v Driver (9th Cir 1971) 441 F2d 1171.”
