OT - Santa Monica smoking ban

... applies to all new tenants of apartments and condos. This isn't to say that I'm interested in having my tenants smoke, but this should be between the landlord and the tenant.

One more reason why CA is a beautiful place, but it would be even MORE beautiful if a wicked tsunami hit and selectively washed the do-gooders, whingers, and meddlers out to sea.

I may add that I rarely smoke and never indoors, but I'd designate my unit smoking if I were an existing tenant. Out of spite, and as a message to the neighbors: "I can do what I want in my apartment. Now UP YOURS!"

so...if you're really smoking in your apt, with windows closed, not getting smoke into anyone else...you'll be fine...no one will know you're smoking or care. but if your smoke is blowinginto your neighbors house...your neighbor has a cause of action.

the reality is people aren't really smoking in their apt. theyre lighting cigs and sending the smoke out into their neighbor's apts.

no smoker wants to smoke in an apt with closed windows and just let the smoke settle there all day, right?

Small claims court? Thus giving neighbors another avenue of harassment against other neighbors that they don't like. Unlike loud music or things like spite-fences, smoke odor is hard to prove since it can't be recorded.

Enforcement by police would almost be better, since cops generally have more important things to do than be the nanny-patrol.

BTW - I'm not sure if smoking with windows closed is actually better. Most walls are somewhat porous -- better to let it out rather than having a stinky apt that would stink up the neighbors as well.

My rule in the car and in my apt is, "if you smoke, it better be next to an open window, even if it's 10F outside."
